Petition Challenging the TNHRCE Act and Rules

The Tamil Nadu Hindu Religious and Charitable Endowments Act of 1959 along with its Rules confers unfettered powers on the delegated authorities of the State to interfere with the religious and administrative affairs of the Hindu community and its religious and charitable institutions. A good number of provisions of the 1959 Act retain the letter and spirit of their predecessor’s (1951 Act) provisions which were struck down in the Shirur Math Case (1954).

Indic Collective Trust along with the custodians of the Tiruchendur Subramanya Swami Temple and few others, has filed a Writ Petition before the Hon’ble Supreme Court, challenging the 1959 Act along with three set of Rules for being violative of Articles 14, 19, 25, 26, 29, and 31A of the Constitution. The Petition has been tagged with the pending Petition of Shri Swami Dayananda Saraswati W.P. (C) No. 476/2012. The Writ Petition filed by the trust is attached below.
